1. Description of services

Productory Services OÜ provides artificial-intelligence training, consulting, and strategic advisory services. We also offer software products such as Ritemark and Lightmark. These are separate services: training and consulting are paid services, Ritemark is currently free and open-source software, and Lightmark is a web service for organisations to assess and develop the maturity of their AI use.

2. Intellectual property

All Productory training materials, presentations, guides, and other materials are protected by copyright. These materials may not be copied, distributed, or used commercially without our written permission.

Ritemark software is open source and distributed under the MIT License. The license is available in the Ritemark GitHub repository. github.com/jarmo-productory/ritemark-public

3. Limitation of liability

Productory is not liable for indirect, incidental, or consequential damages that may result from use of our services. Our training is informational and does not replace professional legal, financial, medical, security, or technical advice.

For Ritemark, the limitation of liability in the MIT License applies. To the extent permitted by law, Productory is not liable for data loss or corruption, third-party service charges or outages, software defects, AI output, or other direct, indirect, or consequential damages arising from use of Ritemark.

4. Payments and billing

Payment for training and services is made according to agreed terms. Invoices must be paid within 14 days of receipt unless otherwise agreed.

5. Changes to terms

We reserve the right to modify these terms. Changes take effect when published on the website. We recommend reviewing the terms regularly.

6. Applicable law

These terms are governed by the laws of the Republic of Estonia. Disputes shall be resolved in Estonian courts unless mandatory law provides otherwise.

7. Ritemark product terms

Desktop application

Ritemark is a free, open-source desktop application for macOS and Windows distributed under the MIT License. It stores and edits files on the user’s device. Ritemark is not a document-hosting or synchronization service.

Artificial-intelligence features

AI features are optional. The Ritemark AI sidebar can connect to Claude Code, Codex, or OpenCode. Depending on the runtime, model, account, and API key selected by the user, these runtimes use external providers or services including Anthropic, OpenAI, Google, and OpenRouter.

Ritemark does not proxy AI requests through a Productory server. The selected runtime connects to its provider using the user’s provider account or API key. Provider terms, privacy policies, availability, usage limits, and charges may apply. Productory does not control those services and is not responsible for their availability, output, retention, or policy changes.

When a user invokes AI, the request may include the prompt and relevant active-file, selected-text, attachment, browser, conversation, and tool-result context. Within the permissions and approvals selected by the user, an agent may also read or modify workspace files or run commands.

AI output and human review

AI output can be inaccurate, incomplete, biased, insecure, or unsuitable. Approval controls reduce unintended actions but do not verify correctness. Users must review important facts, sources, calculations, commands, and file changes before relying on, publishing, or acting on AI output.

No warranties

Ritemark is provided “AS IS” under the MIT License, without warranties of availability, compatibility, output accuracy, data preservation, error-free operation, or uninterrupted third-party service.

User responsibilities

Maintaining appropriate backups and version history
Protecting provider accounts and API keys
Deciding whether information may be sent to the selected provider under applicable law, contracts, and organizational policy
Configuring permissions and reviewing agent actions
Complying with third-party terms and acceptable-use policies
Carrying out any disclosure or review required when AI-assisted content is used or published

Support

Ritemark support is community-based and voluntary. We may provide help on a best-effort basis, but we do not guarantee support or response times.

8. Lightmark service terms

Organisation responsibilities

An organisation using Lightmark is responsible for having a clear purpose and suitable legal basis for inviting people and running an assessment, and for providing the required information to employees or members. The organisation grants access only to people who need it for their work, keeps memberships current, and informs Productory without delay of incorrect access or a possible personal-data breach.

Confidentiality of individual results

A person’s individual answers, personal profile, result, history, and personal recommendations are visible only to that person. The organisation may see participation status and only anonymous aggregates that pass Lightmark’s privacy thresholds. The organisation must not require a person to share a personal result, combine views to infer it, or use a Lightmark result for pay, promotion, performance management, redundancy, or another individual employment decision.

Benchmark and meaning of results

Lightmark may provide an organisation with anonymous aggregate comparisons with other organisations. An observed benchmark does not disclose another customer’s name or an attributable result. Synthetic or blended benchmark provenance is labelled. Maturity stages and recommendations support development discussions and planning; they are not an audit opinion, certification, or guarantee of an organisation’s or person’s actual performance.

Accounts and acceptable use

A user must use their own account, protect sign-in links, and report suspicious activity. Users must not attempt to access another person’s or organisation’s data, bypass privacy thresholds, infer a person or organisation from an anonymous aggregate, disrupt the service, or use Lightmark for an unlawful purpose.

Data processing and service changes

Where Productory processes personal data in Lightmark on behalf of an organisation, the processing is governed by the customer agreement or a separate data-processing agreement. The Lightmark privacy policy describes data categories, visibility, providers, international transfers, retention, and rights. We may change the service for security, reliability, or product-development reasons; we will give the customer reasonable notice of a material change that affects customer data or an agreed function.

Availability and support

Unless the customer agreement states otherwise, Lightmark is provided without a separate guarantee of uninterrupted operation, a fixed response time, or a particular outcome. Where possible, we inform the customer contact of planned maintenance and material service incidents.
